An attorney's bar number is the identifier that ties together the license roster, the discipline record, and any court filings. Ask for it in writing before the first payment.
A woman in Houston paid $3,500 in cash across four visits to an office that advertised immigration services in a strip mall, received a receipt on a photocopied form with no letterhead, and was told her mother's family petition had been filed. Eleven months later she asked for the receipt number. There was no receipt number, because there was no filing, and the man she had been paying held no license of any kind. The tell had been there from the first visit: he described himself as a notary and, separately, as an immigration consultant, and he never once used the word attorney about himself.
Every state has a licensing body, usually called the state bar or the state supreme court's attorney registration office, and every one of them publishes a searchable roster of admitted attorneys. Search by last name, then match on the middle initial and the city, because common names produce several hits and the wrong match is worse than no match. What you want to see is a status line reading active or in good standing, an admission date, and a bar number. Write the bar number down. It is the single identifier that follows an attorney across every record you will later look at.
An attorney admitted in any one state may practice immigration law anywhere in the country, because immigration is federal, so a New Jersey bar card is not a problem for a case filed from Arizona. What is a problem is a card that has lapsed, been suspended, or was never issued. If the person you are paying is admitted in a state they no longer live in, check that state's roster rather than the one where the office sits, and ask directly which jurisdiction admitted them. A licensed attorney answers that question in one sentence without hesitation.
Most state bars post public discipline on the same profile page as the license status, often as a short line reading no public discipline, or as links to orders and consent agreements. Read the underlying document if there is one. A trust account error from 2009 that was corrected and resolved is a different animal from a 2022 suspension for abandoning clients or misusing filing fees, and the profile page will not make that distinction for you. Some states also list pending charges separately from concluded matters, so scan both fields before you decide anything.
Not everyone who may lawfully represent you is an attorney. The Department of Justice recognizes certain nonprofit organizations and accredits individuals within them, and an accredited representative at a recognized organization may prepare and sign filings, communicate with US Citizenship and Immigration Services, and, if the accreditation is full rather than partial, appear before the immigration court. The list of recognized organizations and accredited individuals is published and searchable, and accreditation is time-limited, so check the expiration alongside the name. These organizations typically charge modest fees or nothing at all, and for a straightforward family petition the quality of the work is often indistinguishable from private counsel.
The practical difference is scope and capacity. Accredited representatives sit inside a nonprofit with a defined service area and eligibility screening, so they may decline a case that falls outside their program, and waiting lists at the good ones run long. An attorney takes the case that walks in. Knowing both channels exist means you can price the private option against a free one rather than assuming the private option is the only one.
In much of Latin America a notario publico is a trained attorney with substantial legal authority. A notary public in the United States witnesses signatures and administers oaths, full stop, and holds no authority to give legal advice, select a form, or represent anyone before an immigration agency. The Federal Trade Commission is responsible for policing deceptive practices in consumer services, and unauthorized immigration practice is among the harms it addresses. Several states now prohibit the use of the word notario in advertising for exactly this reason. Treat the term on a sign as a reason to verify, not a credential.
The checks stack in a sensible order. Get the full name and bar number, confirm the roster entry and the discipline record, or confirm the accreditation and the organization's recognition, and only then discuss money. Ten minutes of looking is the cheapest part of the whole case.
Some state bars list pending charges in a separate field from concluded discipline. Check both before drawing a conclusion about a record.
